Scope and contracting parties
These terms apply to contracts between Navin Kaul, trading as TRI-CO-AN – Triathlon Coaching Analysen, Hennakopf 2, 6781 Bartholomäberg, Austria (“TRI-CO-AN”), and customers for personal endurance coaching, training planning and analysis, individual consultations, swimming and video analyses, and sport or technique training.
Mandatory consumer rights remain fully applicable. Explicit agreements in the individual offer take precedence over these terms.
Conclusion of the contract
Website descriptions, prices, the package finder and enquiry buttons invite contact; they are not automatic acceptance or online booking. A contract is formed only when TRI-CO-AN sends a specific offer or order confirmation and the customer accepts it. The contract language is German. Service description, total price, term and these terms are provided on a durable medium before conclusion.

Scope of services
The accepted offer and the service described in it are decisive. Ongoing coaching packages differ particularly in planning rhythm, analysis depth, personal appointments and additional services. Consultations and technique services are separate, clearly limited services.
Plans are based on the communicated goals, availability, performance data and feedback. A specific sporting result, target time, qualification or injury-free development cannot be guaranteed. Necessary professional, organisational or safety-related adjustments remain possible without changing the agreed overall nature of the service.
Digital collaboration
A training platform such as Intervals.icu may be agreed for ongoing coaching. The customer provides a suitable device, internet access and, where required, their own platform account. Temporary third-party disruptions are bridged through an alternative communication channel where reasonably possible.

Customer cooperation
The athlete provides information required for planning and safety accurately and on time, reports relevant symptoms, illness, injury, medication and medical restrictions, and gives timely feedback on tolerance and progress. Third-party login details must not be sent to TRI-CO-AN; regular sharing or provider-supported access routes are used.
Sessions must be adapted or stopped responsibly according to daily readiness, environment, traffic, weather, equipment and personal ability. Training must stop immediately and medical help be sought if pain, dizziness, breathing difficulty or other warning signs occur.

Term and ordinary cancellation
Unless the offer states otherwise, ongoing personal coaching has a minimum term of three months. Either party may cancel effective at the end of this minimum term by giving 14 days’ notice in text form, for example by email. If neither party gives notice in time, the contract renews for one month at a time and may be cancelled with the same 14 days’ notice in text form to the end of each monthly billing period. The right to terminate for serious cause remains unaffected.
One-off services end when fully performed. Simply not using agreed coaching options does not end an ongoing contract.

Illness, injury and medical pause
Interruptions of up to 14 days are reflected in the plan: sessions are reduced, replaced or paused while coaching, communication and payment continue.
If meaningful training is expected to be impossible for at least four consecutive weeks, the athlete may request a medical contract pause in writing with suitable medical confirmation of the sporting restriction and expected duration. A diagnosis need not be disclosed. The pause begins no earlier than the next billing period that has not started and is limited to eight weeks in any twelve-month period.

During an approved pause, planning, analysis, reviews, personal modules, ongoing communication and future payments are suspended. Billing periods already started are not refunded retrospectively. Return must be announced at least seven days in advance; medical clearance may be required where safety warrants it. A fair end to the contract is agreed for longer or permanent inability to exercise.

Personal appointments, cancellation and weather
Appointments may be moved or cancelled free of charge up to 48 hours before they begin. For later cancellation, 50% may be charged; less than 24 hours before the appointment or non-attendance may be charged at 100%, unless the slot can be reassigned. Documented unforeseeable emergencies are considered appropriately.
If TRI-CO-AN cancels, a replacement or refund for the unperformed service is offered. Dangerous weather, water, traffic or facility conditions may require rescheduling or a suitable alternative format. Admission, lane, travel or facility costs are included only when the offer states this explicitly.

Prices, payment and late payment
The total price in the accepted offer applies. Consumer prices are total prices including applicable taxes and charges. Additional costs are charged only when disclosed before conclusion or agreed later.
Ongoing coaching fees are due monthly in arrears, after the billing month. One-off services are due according to the invoice. Unless stated otherwise, invoices are payable within seven days without deduction. Statutory consequences of late payment apply; necessary collection costs are charged only where legally permitted.

Right of withdrawal for distance contracts
Consumers generally have 14 days from conclusion to withdraw from a service contract concluded at a distance or away from business premises without giving a reason. Sending a clear statement to TRI-CO-AN in time is sufficient; the model form below may be used.
If performance is expressly requested during the withdrawal period, a proportionate amount is payable for services already provided after legally compliant information. The right expires after complete performance only when all legal conditions, including explicit consent and acknowledgement, are met. The complete withdrawal information and statutory model form are provided on a durable medium before conclusion.

Health, personal responsibility and liability
TRI-CO-AN provides sport coaching, not medical diagnosis, treatment or therapy. Training and fueling recommendations do not replace medical, physiotherapy or clinical nutrition advice. Seek medical advice before training if there is doubt about health suitability.
TRI-CO-AN is liable under statutory rules. Liability for personal injury, intent, gross negligence or other mandatory liability is not excluded or limited. Where permitted, liability requires loss caused by an attributable breach. Contributory negligence, including concealing relevant restrictions or ignoring clear safety instructions, is considered under statutory rules.

Materials, images, privacy and changes
Rights to materials
Individual plans, analyses, videos, graphics and exercise materials are for personal use. Commercial sharing, publication or modification requires consent; statutory rights remain unaffected.
Photos and videos for promotion
Image, video or audio recordings are published for references or advertising only with separate, voluntary and demonstrable consent. Booking or performance is not conditional on consent, which can be withdrawn for the future.
Privacy
Personal data is processed according to the privacy policy. Health and voluntary cycle data is processed only with separate explicit consent.
Changes
Price and service changes normally apply only to future contracts. Changes to an ongoing contract require agreement unless exclusively favourable, technically mandatory or legally required and reasonable. Mandatory consumer rights remain unaffected.

Applicable law and complaints
Austrian law applies, excluding conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice does not remove mandatory protection of their country of habitual residence. Statutory places of jurisdiction apply.
Complaints can be sent to kaul.navin@gmx.at. The former EU online dispute-resolution platform closed on 20 July 2025 and is therefore not linked. Participation in alternative dispute resolution is explained in a specific dispute as legally required.

PROMOTION TERMS 2026
Your training benefit
Period and eligibility
The “Your next goal starts now” promotion runs from publication through 30 November 2026, 23:59 (Europe/Vienna), exclusively for new clients who have not booked a paid TRI-CO-AN service before their first promotional booking. Existing athletes are excluded from this promotion. New bookings must be concluded by accepting the individual offer by that deadline. A non-binding enquiry alone is not a new booking.
€100 personal coaching credit
Once per person for Core, Performance, Complete or Single Sport Coaching: applied to the first coaching month of a new contract. It cannot be applied to ongoing contracts. No retrospective refunds of already billed services and no cash payout.
15% off one booking
Once per person on one newly booked consultation or front-crawl service, including Quick Check, Video Analysis Pro, individual session, technique block (the whole block) or workshop (your own participation fee). The discount applies to the service fee; separately charged external costs such as pool admission, travel or facility fees are excluded. Dates and scope are fixed in the accepted offer. Previously concluded bookings are not discounted retrospectively.
Discounts and credits
Clients eligible as new clients at their first promotional booking may use the coaching credit and the one-off booking benefit once each within the promotional period. Discounts and credits are not added together on the same invoice or service; the higher applicable benefit applies. This includes the credit of 50% of a consultation fee when coaching begins within 60 days. That credit is calculated from the consultation fee actually paid; only the higher credit is applied to the coaching invoice.
Term, cancellation and withdrawal
Unless otherwise agreed, new personal coaching contracts have a three-month minimum term and can first be cancelled at its end, then at the end of each monthly billing period, with 14 days’ notice in text form (e.g. email). A promotional credit already applied is not reclaimed upon ordinary cancellation. Medical pauses, termination for serious cause and statutory withdrawal rights remain unaffected. Statutory withdrawal is handled according to the law using the agreed discounted price; the promotion creates no additional penalty or repayment obligation.
Price and confirmation
The individual offer or confirmation states the regular price, specific benefit, total payable, start date and term. New coaching: Core and Single Sport €49 in month one, then €149/month (€347 for three months); Performance €79, then €179/month (€437 for three months); Complete €189, then €289/month (€767 for three months). These examples apply when only the €100 credit is used. Contract terms are provided on a durable medium before the contract is concluded.
